Court Drops Warrant Of Arrest Issued Against Genius Kadungure

The Magistrate’s court in Harare has dropped an arrest warrant for Ginimbi, after Kadungure’s lawyer managed to argue that his client missed a flight which caused him to show up for trial.


Prosecutor Ephraim Zinyandu wanted Ginimbi to be remanded in custody until the case is finalised for his failure to attend court which in the prosecutor’s view was willful.

Said Zinyadu:

The record indicates that the accused person had been served with summons to appear in court but chose to go to America. Clearly the accused person is a man of means and may choose whenever he wishes to flee from this court’s jurisdiction.It will be in the interests of justice that he remanded in custody until this case is finalised

However regional magistrate Morgan Nemandire who presided over the hearing revoked Kadungure’s administrative warrant.

Said Nemandire:

The court understood that the accused person missed his flight and had to rebook. Pretrial incarceration is intended for individuals who exhibit a conduct consistent with that of avoiding trial

Kadungure was represented by Jonathan Samukange. He was warned to attend his trial on October 9 without fail.
